Comprehensive Privacy Notice

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations and other applicable provisions, we make this Privacy Notice available to you. It explains what personal data we collect, what we use it for, with whom we share it and how you can exercise your rights. This notice applies to the information we obtain through our website www.gearmaxpro.com.mx, our online store, email, phone, visits to our facilities and WhatsApp Business.

1. Identity and address of the Data Controller

TRAILER GEAR MAX, S.A. DE C.V., doing business as Gearmax Pro (hereinafter, “Gearmax Pro” or “the Controller”), with address at CORREDOR LOTE 3, CAMPO NUMERO 20, CARR A ALVARO OBREGON KM 12, C.P. 31607, CUAUHTÉMOC, CHIHUAHUA, México, is responsible for the processing of your personal data.

2. Personal data we collect

Depending on your relationship with us, we may process the following categories of data:

  • Identification and contact: name, email, landline or mobile phone number (including your WhatsApp number), company and job title.
  • Shipping and delivery: delivery address, address references and recipient details.
  • Tax and billing: RFC (tax ID), legal name, tax regime, tax postal code, CFDI use and tax address.
  • Transactional: history of quotations, orders, payments, returns and warranties.
  • Communications: content of the messages, images, files and voice notes you send us via WhatsApp, email, website chat or forms, as well as the date, time and delivery/read status of those messages.
  • Browsing data: IP address, browser type, pages visited and data collected through cookies (see section 10).

Sensitive data: Gearmax Pro does not request or process sensitive personal data. We ask that you do not send us this type of information through any channel.

Payment data: card payments are processed directly by certified payment providers; Gearmax Pro does not store your full card numbers.

3. Purposes of processing

Primary purposes (necessary for your relationship with us):

  1. Respond to requests for information, quotations and inquiries about products and spare parts.
  2. Process, fulfill, ship and follow up on your orders.
  3. Issue tax receipts (CFDI) and payment complements, and comply with tax and legal obligations.
  4. Manage payments, collections, returns, warranties and after-sales service.
  5. Send you notifications related to your purchase or request via WhatsApp, email or phone: order confirmations, shipping status, tracking numbers, invoices, payment reminders and answers to your inquiries.
  6. Manage your customer account in our online store.

Secondary purposes (not necessary for the relationship, but they help us provide you with better service):

  1. Send you promotions, offers, newsletters and product launches by email or WhatsApp.
  2. Conduct satisfaction surveys and market research.
  3. Compile statistics on the use of our website.

If you do not want your data to be used for the secondary purposes, you can let us know at any time by writing to info@gearmaxpro.com.mx, replying “BAJA” (unsubscribe) to any promotional WhatsApp message, or using the unsubscribe link included in our emails. Your refusal will not be a reason to deny you the products or services you request from us.

4. Use of WhatsApp Business

Gearmax Pro uses the WhatsApp Business Platform, provided by Meta Platforms, Inc. and WhatsApp LLC, integrated with our business management system (Odoo), to communicate with customers and prospects. In this regard:

  • We will only send you WhatsApp messages if you contacted us first through that channel, gave us your mobile number for that purpose, or expressly agreed to receive communications via WhatsApp (opt-in).
  • We process your WhatsApp number, profile name, the content of the messages and files we exchange, and delivery metadata (sent, delivered, read) exclusively for the purposes described in section 3.
  • Messages are stored in our Odoo system, linked to your customer record, to follow up on your service and keep the history of the business relationship.
  • Meta/WhatsApp processes the messages as the platform provider in accordance with its own terms and its WhatsApp Business Policy and Privacy Policy.
  • We do not sell, rent or share your phone number or the content of your conversations with third parties for advertising purposes.
  • You can stop receiving messages at any time by replying “BAJA” or blocking our number; in that case we will only contact you through another channel if it is essential to fulfill an order in progress.

5. Data transfers and disclosures

Your personal data may be shared, without requiring your consent, in the cases provided for by the LFPDPPP, with:

  • The Tax Administration Service (SAT) and Authorized Certification Providers (PAC), for issuing and stamping CFDI.
  • Competent authorities that require it in accordance with the law.

Likewise, in order to operate, we disclose data to providers acting as processors, who process it solely on behalf of and under the instructions of Gearmax Pro: parcel and courier companies (to deliver your orders), payment processors, hosting and software providers (Odoo) and Meta/WhatsApp (messaging). Some of these providers may be located outside Mexico. These disclosures do not require your consent.

We do not carry out transfers of personal data that require your consent.

6. ARCO rights

You have the right to Access your personal data, Rectify it if it is inaccurate or incomplete, Cancel it when you consider that it is not required for the stated purposes, and Oppose its processing for specific purposes (ARCO rights).

To exercise them, send a request to info@gearmaxpro.com.mx containing:

  1. Your full name and a means to send you the response.
  2. A copy of an official ID or, where applicable, documents proving legal representation.
  3. A clear description of the right you wish to exercise and the data involved.
  4. Any information that helps us locate your data (for example, customer number, order number or WhatsApp phone number).

We will respond within a maximum of 20 business days from receipt of your request and, if applicable, we will make it effective within the following 15 business days, in accordance with the deadlines established by current law.

7. Withdrawal of consent and limitation of use

You may withdraw the consent you have given for the processing of your data, or limit its use or disclosure, by following the same procedure described in section 6. Please note that we may not always be able to fulfill your request immediately when a legal obligation (for example, a tax obligation) requires us to keep certain data, and that withdrawing consent may mean we can no longer provide the requested service.

8. Data deletion request (including WhatsApp data)

If you want us to delete your personal data, including your number and the WhatsApp conversation history stored in our systems:

  1. Send an email to info@gearmaxpro.com.mx with the subject “Solicitud de eliminación de datos” (data deletion request), or send us the WhatsApp message “ELIMINAR MIS DATOS” (delete my data).
  2. Provide your name and the phone number or email you used to contact us.
  3. We will verify your identity and confirm the deletion within a maximum of 20 business days.

We will delete or anonymize your data, except for data we must keep due to legal obligations (for example, information contained in invoices, which the Federal Tax Code requires us to keep for at least 5 years). Such data will remain blocked and will only be used to comply with those obligations.

9. Retention and security

We keep your data only for as long as necessary to fulfill the purposes described and the applicable legal obligations. We implement administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use, access or processing, including encrypted connections (HTTPS) and access controls to our systems.

10. Cookies and similar technologies

Our website uses first-party and third-party cookies to keep your session active, remember your shopping cart and language preferences, and obtain browsing statistics. You can disable cookies in your browser settings; however, some site features (such as the online store) may stop working properly.

11. Minors

Our products and services are intended for people over 18 years of age. We do not knowingly collect data from minors.

12. Changes to this Privacy Notice

This notice may be modified due to legal changes or changes in our services or privacy practices. Any change will be published on this same page: www.gearmaxpro.com.mx/politica-privacidad, indicating the date of the last update.

13. Authority

If you believe your right to the protection of your personal data has been violated, you may contact the competent personal data protection authority in Mexico.
